TERMS AND CONDITIONS OF SALE
- Acceptance of Terms
- By placing an order with [Bakery Name], you agree to these terms and conditions, including pricing, payment, cancellation, pickup/delivery, and product disclaimers. If you do not agree with any part, please do not place an order.
- Order Confirmation and Payment
- All orders must be paid in full at time of booking unless otherwise agreed in writing. Custom orders (including custom cakes, large event orders, and specialty items) require a non-refundable deposit of [percentage] to secure the date and production schedule. Until payment is received, your order is not confirmed. Deposits cover recipe development, ingredient sourcing, scheduling, and lost opportunity to book other orders.
- Custom Orders, Changes & Cancellations
- Custom orders are created specifically for you and require detailed specifications. Changes to custom orders (size, flavor, design) must be requested in writing no later than [number] days before the scheduled pickup or delivery. Once production has begun, changes cannot be guaranteed. Cancellations of custom orders after confirmation may be accepted but the deposit will be forfeited; further refund eligibility will depend on work already done and costs incurred.
- Perishable Goods and Final Sale
- Baked goods are perishable. All sales are final upon completion of order, except in cases where the bakery is unable to fulfil the order, or where an item is materially defective. Canadian rules generally do not require businesses to accept returns on food items unless defective, but we will work with you on reasonable quality concerns raised promptly after pickup or delivery.
- Allergy and Ingredient Disclosures
- Our products may contain or come into contact with allergens such as wheat/gluten, dairy, eggs, nuts, soy, and others. While we take care to identify ingredients and minimize cross-contact, we cannot guarantee allergen-free products. Customers must inform the bakery of allergies before ordering and assume responsibility for consumption decisions. Allergen labelling must be accurate and truthful under Canadian food law; misrepresentation can carry penalties from regulatory authorities such as the CFIA or Health Canada.
- Pickup and Delivery
- You agree to pick up your order on the specified date and time. If the order is not collected within a reasonable window and we cannot reach you, the order may be treated as completed, and no refund will be issued. For delivery services, please ensure delivery details (address, contact number) are complete and accurate; we are not responsible for late, missed, or unclaimed deliveries due to customer error.
Limitation of Liability
Our liability for any claim related to baked goods, services, or products (including claims for defective items) is limited to the purchase price of the affected item(s). We are not liable for indirect, special, or consequential losses. Nothing in these terms limits liability for personal injury caused by proven negligence. In the event of a dispute, both parties agree to attempt to resolve it reasonably before pursuing legal action.
